本会出版关于比南社群的新书 谈砂劳越在保护土族习俗权的系统性失败 SAM new publication on the Penan community: Systemic failure to protect the NCR in Sarawak

在2002年,砂劳越比南人协会发表由四十多位社群领袖签署的《2002年弄砂燕宣言》。宣言提出包括以下要求:停止在所有比南人地区伐木;在宪报上公布比南人地区为社群森林保留地;为比南社群提供实际的保健与教育服务,有素质的住所,电力与净水以及农业方面的培训与资助。

十多年过去了,然而,总的来说,砂劳越比南族仍然生活在土地权无保障的次等生存环境。更糟的是,滥伐林木超过三十年,结果天然木材减少,木材业走下坡,很快被栽种的木材林和油棕园取代。开种植园需先清除伐过木的森林,结果使一直受伐木严重影响的原住民社群更加困难。  

我们的新书,《砂劳越比南人的土地权——<2002年弄砂燕宣言>发表十三年后的情况》,阐发我们的主张。本书收录一些本会与比南社群组织在2000年至2013年发表的文献,记录了比南社群这十多年来的斗争、不平和要求。  

这本新书让我们看到,砂州政府和联邦政府一直没解决人民的各种土地权与福利问题。这说明土著社群受到系统性的压迫;政府有失于良政。  

尽管去年沙州政府多次声明要加强执法保护森林,但受影响社群觉得实际上情况与过去一样。  

这种现实情况不仅发生在比南社群,还蔓延到其他社群。就在今年7月,峇南弄皮拉加央族村民阿正·卓,在刑事法典第379A条下被控“偷窃”伐木公司的财物。这家公司是自今年4月就被弄皮拉人民设路障封锁;村民也曾多次报警。据报道,村民多次赴砂州森林局索取有关伐木执照的详情,该局都以敏感为由拒绝。在没其他办法之下,在今年6月,村民被迫扣下该公司的设备,等它答应撤离才归还。  

砂州政府三十多年来对原住民,尤其是比南人,许下很多承诺,现在该提问了:砂州政府做了什么来保障他们的习俗地权和提高他们的生活水平?我们的新书、弄皮拉最新的案件、峇南水坝影响社群设立两年了的封锁路障、大种植园的出现,这一切说明政府做得很少。此外,大部分砂州土著社群还得不到水电供应和良好的卫生、教育与交通服务。  

配合州政府的最新言论和承认政府在司法上有保护本土人民利益的责任 ,我们便在此要求砂州政府说明为何一直不曾做到?现在要怎样加强保护原住民社群的土地权和改善他们的生活?

Sahabat Alam Malaysia adalah satu badan bukan kerajaan (NGO) yang telah sekian lama berjuang mempertahan kelestarian alam. Ia juga mendidik masyarakat tentang pentingnya kebersamaan dalam pemikiran dan tindakan agar alam ini dapat kita wariskan kepada generasi hadapan dalam keadaan yang elok dan terpelihara. Sebagai contoh SAM telah berjaya menyedarkan masyarakat nelayan keperluan menjaga hutan paya bakau untuk kebaikan hasil tangkapan nelayan itu sendiri.

During the 1980s, I used to read about the Consumers’ Association of Penang (CAP) in the news. After retirement, some time in 2001, while lazing around, I read news about the construction of a carbon in leach plant using sodium cyanide to extract gold in Bukit Koman. My friends and I visited CAP and we were introduced to SAM and her legal team. We discussed the details of filing a case against the gold mining company and the department of environment with Ms Meenakshi Raman and her legal team. That was the beginning of a beautiful friendship between lawyers from SAM and many of us from Bukit Koman. We had many ups and downs in our struggle to shut down the gold mine that was causing a nuisance in our village. But, as a community we never gave up because SAM had our backs.

Sahabat Alam Malaysia adalah sebuah NGO yang memperjuangkan nasib masyarakat luar bandar khasnya. SAM menerima aduan-aduan masyarakat dan menyelesaikan masalah yang dihadapi. SAM telah mewujudkan ramai aktivis-aktivis sosial dan alam sekitar. Pada era 1980 dan 90an SAM sangat dihormati oleh masyarakat dan agensi kerajaan. Apabila media sosial menguasai maklumat maka SAM pun terkesan dan masalah masyarakat terus disalurkan dengan pelbagai cara. SAM perlu mewujudkan aktivis-aktivis pelapis yang muda untuk terus membantu masyarakat. SAM juga perlu membuat perubahan supaya banyak turun kelapangan dan jangan mengharapkan laporan media sahaja. Tingkatkan prestasi sebagaimana pada zaman kegemilangan SAM di era 80-90an.

My journey with SAM started when her community organisers took me to the meet the paddy farmers of Kedah, connecting my growing interest in environmental law with our people who struggle to work the land in the face of pollution, replacement of traditional seeds with commercial hybrids and their accompanying chemical package of fertilisers and weedicides. I then had the honour to work with SAM in the struggle for the rights of the native communities of Sarawak, in defence of their forests from massive logging and destructive mega-projects. In every issue that SAM takes up, she combines rigorous research with the realities and voices of the communities to advocate for policies and laws that care for people and nature. From the courts to the elected legislators to policy makers and implementers and to the United Nations, SAM walks side by side with the communities in Malaysia. How can I not be inspired by the vision and passion of the generations of women and men who coalesce to form SAM?
